That the Wisconsin Fair Employment Law prohibits employment discrimination based on:
- age (40+)
- ancestry
- arrest or conviction record
- color
- creed
- handicap or disability
- marital status
- national origin
- race
- religion
- sex (including pregnancy, gender identity, and sexual orientation)
- genetic information
- veteran status
- or any other protected class
This law protects employees and job applicants when it involves any of these above protected classes. Employers need to proceed with caution when hiring or firing employees in these protected classes.
Some practical examples of employment discrimination are sexual harassment, promoting someone based on race, denying someone equal pay/compensation based on their gender, assuming older people’s mental or physical capacity is negatively affected by aging.
Employers are reminded that it is best practice to include a good EEO (Equal Employment Opportunity) statement in their employee handbooks. The statement can be simple like “it is the policy of (Name of company) not to discriminate against any applicant for employment or employee because of age, color, sex, disability, national origin, race, religion, veteran status or any other protected class”.
